1. Service Agreement
These Terms of Service (“Terms”) govern your access to Topoli.com.au and the purchase of custom 3D figures created by Prosoft Tech Pty LTD (“we,” “us,” or “our”). By placing an order, you confirm that you are at least 18 years old and agree to be bound by these Terms.
2. Intellectual Property & Uploaded Artwork
- Ownership: You retain full copyright and ownership of any original drawings and artwork uploaded to our website.
- Manufacturing License: By submitting artwork, you grant us a non-exclusive, world-wide, royalty-free license to use, adapt, render, and reproduce the design solely to model, manufacture, quality-check, and deliver your figure.
- Warranties: You warrant that you are the parent, legal guardian, or authorized representative of the artist, and that uploaded files do not infringe on any third-party intellectual property, trademarks (e.g., commercial cartoon characters), or copyrights.
3. Bespoke 2D-to-3D Interpretation
Our products are custom, hand-sculpted digital interpretations of 2D drawings. By ordering, you acknowledge that:
- 2D drawings require modifications (such as thickening thin lines or adding structural bases) to render them physically stable for 3D printing.
- Physical product colors and textures may vary slightly from screen displays and original paper drawings due to digital rendering and printing material constraints.
4. Cancellations
Because custom 3D sculpting begins shortly after submission, orders may only be canceled within 2 hours of placement. Once digital sculpting or 3D printing has commenced, orders cannot be canceled, refunded, or modified.
5. Refunds & Australian Consumer Law (ACL)
- Change of Mind: Under Australian Consumer Law, custom-made items made to your specific specifications are non-refundable for a change of mind.
- Damaged or Faulty Goods: Our products come with guarantees that cannot be excluded under the ACL. If your figure arrives broken, defective, or materially damaged in transit, notify us within 7 days of delivery with photos. We will provide a replacement or full refund at our discretion.
